The basis for notice and take-down procedures under EU law is article 14 of the Electronic Commerce Directive, adopted in 2000, article 14 applies to content in relation to all “illegal activity or information”. Million Euro Listings are not liable for the illegal activity, or information placed on its systems by a online users, agents, bloggers, pod-caster or video producers so long as the Million Euro Listings does not have “actual knowledge” of the activity or information which may offend. Once notified by the owner or the rights to its publication or the distribution agent, upon obtaining such knowledge, Million Euro Listings will act expeditiously to remove or to disable access to the information upon being notified of any copyright infringement and will immediately fall into the take-down procedures upon receiving notice that it was posted without authorization from the copyright owners or their agents without further action being taken once the  take-down procedure has been acknowledged by Million Euro Listings.

The DMCA notice and take-down process is a tool for copyright holders to get user-uploaded material that infringes their copyrights taken down off the websites. The process entails the copyright owner (or the owner’s agent) sending a take-down notice to the service provider, platform, website operator, web host, blog,  requesting that the provider to remove the material that is infringing their copyright.

We will need direct URLs to the content/image(s) being referenced. If URLs are not available, we will need screenshots.

Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
